Fee Arrangements
Communication is important with respect to fees. Before we begin working with a new client, we thoroughly discuss with the client our fees and we both sign a written engagement letter that explains how fees and expenses will be incurred and paid.
Fees are generally based on the hours spent by the attorneys working on the matter billed at the attorneys’ billing rates. While we bill hourly for our work on many transaction matters and lawsuits, we also consider and discuss with our clients other fee arrangements. These may include fixed fees for certain transaction or planning matters (such as preparation of estate planning documents, corporate formation documents, etc.)
Sometimes, clients have suffered a loss and have a legitimate claim but do not have the funds to hire attorneys and pay for their work on an hourly basis. For litigation work, we often enter into alternative fee arrangements with these clients, which may include a contingent fee agreement. Under a contingent fee agreement, typically the client will pay for litigation out-of-pocket expenses, but our fees for legal services will be based upon a percentage of the client’s recovery, if one is obtained. We often enter into contingent fee agreements on a variety of business and personal disputes, including will and trust contests, oil and gas royalty or other disputes, breach of fiduciary duty disputes, shareholder, business and employment disputes, and other types of business litigation.
